For blacks and Latinos, few Calif. high schools offer path to college

California high schools that serve largely Latino or African American students are failing them as pathways to college, according to a new report by a statewide education policy, research and advocacy organization.

Just 10 percent of high schools that serve primarily Latino students have above-average graduation and college-going rates for Latinos. The same is true for African Americans at 24 percent of high schools serving the largest proportions of African American students, the Education Trust?West found. Many students in both populations are low-income.

The college-going rate among Latino and African American students who graduated high school in 2010 lagged behind that of white and Asian students by 20 and more than 30 percentage points, respectively. The estimate, released last week, found 45 percent of Latinos and 46 percent of African Americans in the class of 2010 enrolled in college.

Researchers analyzed high school graduation rates for students who earned diplomas in 2010 and estimated their college-going rates using data from 2009, the first year such information was available. Their findings, they said, were disturbing.

"Far too few schools with large populations of African American, Latino and low-income students are serving as pipelines to post-secondary education," the report said. Post-secondary education includes both community colleges and four-year universities.

Among high schools with the highest proportions of African American students, 52 percent were considered either "broken pipelines," schools where African Americans graduate and go on to college at lower rates than statewide averages, or "not college bound," schools where African Americans had higher-than-average graduation rates but lower college-going rates.

Nine out of 10 Latino-dominant high schools were either broken pipelines or not college bound, researchers found.

Still, Orville Jackson, senior research analyst at the Education Trust?West, said he was pleased to find a number of schools serving as college pipelines.

There were "not as many as we'd like, but at least (there were) some schools where we could highlight where it's possible," he said. "They're kind of showing that it can be done ? that you can both graduate above average and send those kids on to college."

Imperial High School is among those identified as a college pipeline. The school, located less than 20 miles north of the Mexican border in Imperial County, has about 1,000 students, three-fourths of whom are Latino.

Ninety-two percent of Imperial High's Latino students graduated in 2010, according to the report. Among graduates, an estimated 78 percent went on to college.

Imperial High partners with its district's middle school, the local community college and San Diego State University to instill a "college-going culture," said Roger Ruvalcaba, the school's principal.

Although its graduation requirements do not mirror entrance requirements for the University of California and California State University systems ? something the Education Trust?West recommends for all high schools ? the school's counselors discuss both graduation and state university admissions requirements starting in eighth grade, Ruvalcaba said.

The school has also made efforts to make college preparation the default. In previous years, the school offered seniors an after-school opportunity to take a reading, writing and math exam?for placement at community colleges; about 75 to 80 students typically participated, Ruvalcaba said. This year, however, Imperial High integrated the test into the school day and had all its seniors participate.?

As a result, all seniors had test scores they could use at nearby Imperial Valley College ? where most of the school's graduates matriculate ? or other community colleges. Even for students who plan to attend four-year universities, Ruvalcaba said, the test shows them where they could place at a post-secondary level.

"You always have kids who say they're going to go away (to college) and then something happens," he said. "It's just another thing that helps them."

Orville would like to see more schools like Imperial High.

"If we increase the rigor and requirements at our high schools, that's going to be good for everyone," he said. "We need to have high expectations for all students."

(AP) ? Firefighters searching for bodies in the nearly 350 homes burned by the most destructive wildfire in Colorado history found a second body Friday at a residence where another person was discovered dead earlier.

As crews on the front lines made slow but steady progress against the flames, Police Chief Pete Carey said fewer than 10 people altogether were unaccounted for. The remains of one person were found Thursday in what was left standing of one home. He confirmed that the remains of a second person who lived there were found Friday.

The 26-square-mile blaze ? one of several wildfires burning out of control across the tinder-dry West ? was reported to be 25 percent contained, and authorities began lifting some of the evacuation orders for the more than 30,000 people who fled their homes a few days ago.

After growing explosively earlier in the week, the fire gained no ground overnight, authorities reported Friday. And the weather was clear and mostly calm, a welcome break from the lightning and high wind that drove the flames.

"The focus for today is to hold what we got," extend the fire lines to contain more of the blaze, and bring in more heavy equipment, said Rich Harvey, incident commander for the fire.

Exhausted firefighters fresh off the front lines described the devastation in some neighborhoods and the challenges of battling such a huge blaze.

"It looks like hell. I would imagine it felt like a nuclear bomb went off. There was fire everywhere. Everything had a square shape to it because it was foundations," said Rich Rexach, who had been working 12-hour days since Tuesday, when flames swept through neighborhoods in this city of more than 400,000 people 60 miles south of Denver.

"Everything you put water on, it was just swallowing it," he said.

President Barack Obama toured the stricken areas Friday after issuing a disaster declaration for Colorado that frees up federal funds. He thanked firefighters and other emergency workers, saying: "The country is grateful for your work. The country's got your back."

As residents waited anxiously to see what was left of their homes, police reported several burglaries in evacuated areas, along with break-ins of cars packed with evacuees' possessions outside hotels.

Carey said Friday a person wearing protective fire gear in an evacuated area was arrested on charges of impersonating a firefighter and influencing a public official.

"We were able to stop him and identify that person as somebody that probably wasn't someone who belonged on that scene," Carey said. He didn't have the person's name.

Earlier this month, a man was arrested on suspicion of impersonating a firefighter at a different blaze in northern Colorado.

Community leaders began notifying residents Thursday that their homes were destroyed. Lists of the heavily damaged streets were posted at a high school, and residents scanned the sheets, but for many, the notification was a formality. They had already recognized their streets on the aerial pictures that appeared in the news.

"The blanket that was on my bed when I grew up, a bunch of things my mother had made," said Rick Spraycar, listing what he lost when his house in the hard-hit Mountain Shadows subdivision burned down. "It's hard to put it into words. Everything I owned. Memories."

For Ernie Storti the pain of knowing that his was one of a handful of homes spared in his neighborhood was hard.

"Our home was standing, and everything south of us was gone," he said as tears streamed down his face outside a Red Cross Shelter where he had met with insurance agents.

Authorities were still trying to figure out what caused the fire. They said conditions were too dangerous to allow them in to start their investigation.

More than 1,000 personnel and six helicopters were fighting the fire.

All eight Air Force firefighting planes from four states will be at Colorado Springs' Peterson Air Force Base Saturday and available to fight the fire, marking the first time the entire fleet has been activated since 2008, Col. Jerry Champlin said.

Among the fires elsewhere in the West:

? At least 60 homes near Pocatello, Idaho, burned in a fast-moving wildfire that started Thursday evening. The blaze covered more than 1? square miles. Officials said it was human-caused but gave no details.

? A 70-square-mile wildfire in Utah destroyed at least 160 structures, more than 50 of them primary homes. Another blaze in Utah doubled in size to 70 square miles and was threatening about 75 structures. And a wildfire that erupted Friday in a foothills community near Salt Lake City destroyed at least two homes and was threatening 200 others.

Blazes also burned in Wyoming and Montana.

Authorities battling six wildfires in Utah said Colorado was taking most of the available fire crews, leaving them short-handed.

Fire commander Cheto Olais said leaders at one Utah blaze had requested about 200 additional firefighters but will probably get no more than 20. "A lot of assets are going to Colorado," Olais said.

Plane hijacking foiled in restive western China

(AP) ? Passengers and crew foiled a hijacking attempt by six people on a plane in China's restive far-western Xinjiang region Friday, a regional airline and state media said.

The attempt was made just after the plane took off from Hotan in southern Xinjiang for the regional capital of Urumqi and the six suspects were detained after the plane returned safely, the Tianshan regional government's news portal said.

Tianjin Airlines said on its website that the plane returned to Hotan 22 minutes after takeoff.

Tianshan's report did not give further details, such as how the hijacking was foiled, how many passengers were on the plane or what was known about the suspects' motive or ethnicity.

Hotan has been the scene of recent clashes between ethnic Uighurs (pronounced WEE'-gurs) and authorities. The Uighurs say they resent government controls on their religion and culture.

The government says China faces an organized terrorist threat from radical Muslim groups in the region and that it has invested heavily to raise living standards in Xinjiang.

The phone listed for Hotan police rang unanswered Friday. A man who identified himself as a police officer and gave only his family name Wang at Xinjiang Department of Public Security said no more information on the hijacking attempt was available.

In 2008, state media reported that a Uighur woman made an unsuccessful attempt to hijack a passenger plane flying to Beijing from Urumqi.

In general, threats to civil aviation in China are believed to be rare.

Choose the right foods to eat and you will be able to concentrate, feel alert, and get things done. Eat the wrong things and you?ll lack focus, feel sluggish, and want to take a nap. Unfortunately, no one teaches us which foods help or hurt our ability to focus better.

I wish this wasn?t true. I used to find myself feeling tired, sluggish, and unable to get work done after eating what I thought was a healthy meal. This led to me doing a lot of research and experimentation to find foods that give me the energy I need to focus and work hard for 60 hours a week. After a few months of trial and error I came up with 6 foods and 1 drink that really work.

You?ll probably wonder why coffee and tea aren?t on the list. While both work due to their caffeine content, I wanted to find foods that also had additional nutritional value (i.e. protein, vitamins and minerals, etc.). I also figured it?d be cool to know additional ways to boost brainpower.

Blueberries
Studies show that eating blueberries can improve your ability to concentrate and perform tasks requiring you to really focus. Scientists still don?t know why they?re beneficial. Some believe that it may be their high antioxidant content which helps vacuum up potentially damaging free radicals. Others suggest it?s their ability to reduce inflammation and increase the flow of blood and oxygen to your brain. Whatever it is, blueberries are a tasty, brain friendly food. I find that my energy stays consistent for several hours after eating them, especially when added to a protein shake or plain yogurt.

How much should you eat? You eat 1 cup a day. Eat them alone or add them to a protein shake for a delicious snack. Avoid eating them with sugar-rich desserts the blood sugar spike you?ll get may diminish their brain boosting benefits. Don?t expect to see instant brain-boosting benefits. The benefits are more likely to occur over time.

Dark Chocolate
This will probably be your favorite brain boosting food. Chocolate, especially the dark stuff contains compounds called flavonols that can help improve mental focus. Studies show that drinking flavanol rich cocoa helps increase blood flow to your brain which, in turn, improves your ability to concentrate. A single square of dark chocolate also contains a small amount of caffeine too which also improves mental energy and focus.

Eat 2-3 squares of dark chocolate a day. The darker the chocolate the better.

Eggs
The simple egg is an awesome food for boosting your ability to focus. That?s why I eat them several times a week. I really notice a difference in my productivity after eating them for breakfast, lunch, or dinner.
Each serving of eggs are rich in protein, B vitamins, and choline. Each plays a key role in keeping your brain healthy. The choline in eggs is especially important since it?s a component in the cells of your brain. It?s also used to make acetylcholine, a compound that helps your brain send messages from one cell to another.

Eat eggs 3-4 days a week for the best results. You shouldn?t worry about their cholesterol content either. Studies show that it?s not bad for your heart. Don?t throw away the yolks as this it the part of the egg where the B vitamins, choline, and other brain healthy nutrients are contained.

Fatty Fish
Once I started eating fatty fish and taking a fish oil supplement daily I noticed that I was my ADD like tendencies diminished and I was able to get more work done in less time. I feel calmer too. The reason for this are the omega 3 fats found in fish like anchovies, mackerel, salmon, and sardines. One of these omega 3?s, DHA is found in large amounts within our brains. The other, EPA is converted to DHA once it?s been consumed.

EPA and DHA help our brains in a few ways. The first is that they increase the ability of the cells in our brain to communicate with one another. This makes it easier for your brain to properly function. Another is that omega 3 fats increase the production of dopamine and serotonin, two chemicals that have important roles with regard to mental focus. Dopamine helps spur you into action and get you to work while also making it possible for you to focus on the task at hand. Serotonin on the other hand helps to keep you feeling calm and better able to deal with stress which also makes it easier for you to concentrate and get things done.

Strive to eat fish at least 2-3 times a week to receive benefit. You may need to eat it more often or take a fish oil supplement to see significant results. Expect it to take a couple of weeks before you notice significant results.

Nuts And Seeds
Eating certain nuts and seeds can help your focus and brain function. They include: walnuts which are shown to boost serotonin levels so you?re better at handling stress, cashews which are rich in magnesium a mineral that can increase blood flow to your brain, and almonds a seed that is rich in phenylalanine an amino acid that helps produce the focus boosting chemical dopamine. I like to buy them raw and roast them myself. This allows me to come up with my own recipes and is much less expensive than buying a bag of roasted nuts.

Eat a handful of these nuts and seeds daily for the best results. You can eat them alone or add them to your favorite recipes. I like them with roasted fish and mixed in with yogurt.

Steak
A nice, lean cut of steak is is full of other nutrients that are good for your brain. It?s rich in B vitamins which your brain uses for fuel and proper function. Every serving also contains creatine, which your body uses for fuel. You also get a nice dose of the amino acid l-tyrosine which is used to make dopamine which, like I previously wrote, helps your brain stay alert, energized and able to fully focus. Since steak digests slowly, it will keep you full between meals minimizing energy crashes and brain fog too.

How much do you need? You can eat steak as often as you like. Aim for 2-3 servings a week, especially on days you really need to focus. I like to eat it for breakfast with our without eggs and find doing so makes it much easier to focus all morning long. If you eat steak regularly, eat lean cuts like flank, flat iron, filet mignon, and sirloin.

Water
Sure, it?s not as sexy as chocolate or tasty as steak but drinking good old water throughout the day instead of soda and other sweetened drinks is of paramount importance to keeping your brain in working order. As you know, water is required for your body to stay hydrated. This is important to our brains since being even a little dehydrated compromises our brains ability to function properly. This means instead of being able to focus you will instead feel lethargic and short of mental energy. Become dehydrated enough and you will find yourself feeling depressed and really out of sorts.

Most experts recommend drinking 8 glasses of water a day. Depending on your activity levels, you may require more or less for optimal results.Since I work out daily, I need to drink 12 or more glass every day. When I drink less my mental energy really wanes.

Putting It All Together
Now you know several foods to you can eat any time for better focus and mental energy. Give these suggestions a try for a month and I guarantee that you will find that you?re able to get more done in less time.

Many Apple fans on the opposite side of the Pacific from Cupertino haven't had much of a choice to shop from iTunes, even though they've had the App Store for some time. There's now a much better sense of balance: Apple just flicked the switch on the iTunes Store for music and movies in a dozen countries and territories across the Asia-Pacific region. The company singles out our own Richard Lai's Hong Kong as well as Singapore and Taiwan, but we'd be remiss if we didn't mention that Brunei, Cambodia, Laos, Macau, Malaysia, the Philippines, Sri Lanka, Thailand and Vietnam are also getting the media catalogs, which include local content along with the international hits. It's a full catch-up as well, with iTunes in the Cloud re-downloads and iTunes Match subscriptions available in every new country. If you're a huge Andy Lau fan but wanted his albums from the most iPhone-friendly store possible, the wait is over.

Two feet of rain, thousands flee Debby floods

River flooding form Tropical Depression Debby -- downgraded from a tropical storm late Tuesday -- forced up to 20,000 people out of their homes in one Florida county alone, while another area had already seen more than 26 inches of rain, topping the official forecast calling for up to 25 inches in a few areas by the time Debby moves out.

In Pasco County near Tampa Bay, a mandatory evacuation was ordered between the Anclote and Pithlachascotee rivers, Reuters reported. The Anclote rose from 9 feet before Debby's approach to more than 27 feet on Tuesday, flooding areas with water head-high in places.

Boats were used to reach stranded residents, and 106 homes had been damaged.

Wakulla County, meanwhile, has seen more than 26 inches of rain, weather.com said in a Twitter alert Tuesday morning. Authorities there advised people to stay in their homes due to washed out and flooded roads.

Flash flood warnings were issued for parts of northern Florida and southern Georgia as Debby moved eastward. By midday, Debby picked up speed to 6 mph and winds had dropped to 40 mph, but that didn't stop the rain.

Parts of Interstate 10 in north Florida were closed due to flooding on a 50-mile stretch between Jacksonville and Tallahassee. The Florida Highway Patrol warned motorists to use extreme caution on other parts of the highway.

Hundreds of thousands of people have been impacted, many having to leave flooded homes in Florida's Panhandle on Monday and others losing power or having property hit by twisters.

In Tampa Bay, a mother manatee was found dead in the water Tuesday off Bayshore Boulevard. Her two calves, which were still alive and later rescued, washed ashore along the flooded road.

Earlier in the day, tropical-storm warnings were in effect for 450 miles of coastline -- from the Panhandle's Mexico Beach to Englewood, south of Sarasota.

Debby made landfall near Steinhatchee on Tuesday afternoon, earlier than expected. Despite the downgrade to a tropical depression, Debby was still dumping rain and could return as a tropical storm when it exits Florida's Atlantic coast.

On Monday, Florida Gov. Rick Scott declared a statewide emergency as five inches of rain in the course of an hour fell on some areas.

President Barack Obama called Scott on Tuesday and the federal government stands "ready to provide additional assistance if necessary," the White House said.

St. Marks, Fla., saw 21 inches in a two-day period while other areas got around 20 inches, weather.com noted.

Parts of Live Oak, Fla., were evacuated Tuesday due to flooding, it added.

Some areas of northern Florida and southeast Georgia could see up to 15 inches of rain Tuesday through Thursday, weather.com stated.

The National Hurricane Center predicted parts of northern Florida could see 25 inches of rain by the time Debby crosses Florida and exits into the Atlantic.

Weather.com noted that 2012 broke the record for the most named storms so early in the Atlantic season. Debby makes four so far, "leapfrogging Dennis from July 5, 2005.

"In an average year, the fourth named storm would have occurred by August 23," it added. "In terms of named storm counts, we're roughly two months ahead of the pace. That said, there is no correlation between a fast start to the season and the degree of activity of the rest of the season."

Debby was also the first tropical storm of the season to enter the Gulf of Mexico.

Debby earlier left tens of thousands of people without power and forced the closure of key highways and bridges in the Tampa Bay area.

Debby has also spawned some 20 twisters, including one on Sunday that killed a woman, injured her daughter and tore through homes in central Florida's rural Highlands County.

WFLA-TV reported Heather Town died when her home was lifted off its foundation and she and her 3-year-old were thrown into nearby woods. The mother was found clutching the child, who survived.

In Starke, Fla., five dogs drowned early Monday when a swollen creek flooded an animal shelter, The Florida Times-Union reported.

Pinellas County saw flooding and at least 20 homes damaged during a tornado-like storm on Sunday.

As Commissioner Roger Goodell continues to deliberate the final rulings in the bounty suspension appeals, the league over which he presides continues to declare the players? guilt.

NFL spokesman Greg Aiello said Tuesday, via the Associated Press, that the evidence is ?overwhelming.?

?The investigation was thorough and includes statements from multiple sources with firsthand knowledge about the details of the program, corroborating documentation and other evidence,? Aiello said.? ?The enforcement of the bounty rule is important to protect players that are put at risk by this kind of scheme.?

Aiello?s comments come on the same day that Saints quarterback Drew Brees is questioning via an all-day media blitz the quality of the league?s case, and four days after NFL general counsel Jeff Pash touted the ?mosaic? of evidence that was presented during the June 18 appeal hearings.

?Certainly, Drew Brees would not want to be the target in a bounty scheme and that is why we must eliminate bounties from football,? Aiello said.

Given the league?s views, the appeals should have been denied by now.? As Saints linebacker Jonathan Vilma said Monday, ?What?s this guy waiting on?? Make your ruling so we can get on with phase 2 already.?

Also, the dueling soundbites from the league and Brees further illustrate that, ultimately, the bounty case has become an exercise in semantics.? No players were paid to injure other players.? Instead, the Saints created a system for financially rewarding players who in the normal course of delivering big, clean, legal hits rendered an opponent unable to play in all or part of the remainder of the game.? Though that?s one of the realities of a game in which success is premised partially on attrition, the league believes that creating that kind of incentive could lead to deliberate attempts to injure, whether through legal hits or through illegal hits.

The players believe the NFL has tried to suggest that the Saints were doing something far more sinister than the jobs they?re already paid to do (i.e., hit the other guy as hard as you can, cleanly and legally).? The NFL believes that, regardless of the language used to describe it, the concept of offering players money for rendering opponents unable to continue to play is inherently sinister, and thus unacceptable.

Regardless of how it all plays out, Aiello?s comments make clear that there?s no reason to further delay the rulings on the appeals.? Phase One clearly is over; it?s time to get on with Phase Two.

Sony Xperia Ion (AT&T)


With terrific TV connectivity and a 12-megapixel camera, Sony's Xperia Ion ($99.99 with contract) is the ideal Android phone?for folks who want to take their movies everywhere, showing them on any screen available. It's quirky and not an industry leader in other ways, though, with weak phone calling performance and some other bugs.

Physical Design
The Xperia Ion is a large phone, the way phones seem to be nowadays. It's 5.2 by 2.7 by .4 inches (HWD) and a solid 5.1 ounces, all in black with a curved metal back that makes it wobble a little bit when placed down on a table. It feels like it's made of premium materials: The screen is cold glass, and the top and bottom of the back are soft-touch plastic. You're getting your money's worth here.

The front is mostly a 4.55-inch, 1280-by-720-pixel TFT LCD screen. The screen has unusually deep blacks, thanks to a technology Sony calls "mobile Bravia." Below the screen there are the usual four silkscreened soft buttons for Android actions. The headphone jack is on top, and there's a dedicated camera key on the side.

The Xperia Ion's battery isn't removable, but a sliver of the top of the back cover is, letting you pop in a microSIM card and MicroSD memory card.

Call Quality, Wireless and Battery
I didn't find the Ion to be a very good phone. Reception isn't the problem?volume is. The Ion's speaker is quiet, and its speakerphone is so quiet as to be barely usable. Making a call in a noisy outdoor area I could hardly hear my wife on the other end of the line, in either mode.

There's little noise cancellation in the microphone, too, so background noise comes through very clearly on the other side of calls. A call made from the Ion sounded a bit scratchy on the other end, and a call made from the Ion's speakerphone sounded muddy. In this case, a Bluetooth headset actually improved things.

The Ion is an AT&T-compatible LTE phone with national and global HSPA+ roaming, although it doesn't support T-Mobile's 3G band. AT&T only has LTE in 39 cities right now, but where it does, speed is scorching, usually exceeding 10Mbps down. The phone works as a Wi-Fi hotspot with the appropriate service plan.

Bluetooth and GPS make their usual appearance, and the GPS locked into our location without a problem. The Ion also supports two lesser-used wireless technologies: ANT and NFC. ANT+ is mostly used for health-and-fitness devices. NFC's most prominent app right now is Google Wallet, but Google Wallet isn't available in the Ion's Google Play market.

Battery life was mediocre, but not awful, with 5 hours and 20 minutes of talk time.?

Performance
The Ion runs Android 2.3.7 (Gingerbread) on a Qualcomm S3, 1.5GHz dual-core processor. This doesn't offer quite the speed we've seen from the S4 processor in the likes of the HTC One X ($199, 4.5 stars) and?Samsung Galaxy S III ($199, 4.5 stars), especially when it comes to gaming frame rates, but it does fine on benchmarks.?The interface was generally responsive, but the soft buttons at the bottom of the screen sometimes didn't respond to touches.

Sony's approach to Android adds a relatively light skin and some bloatware. You have various options to sort apps in the App Tray, for instance, and a very useful new Power Manager app which can turn off power-hungry radios when your battery is low.

Optional Facebook integration lets you add Facebook contacts and calendars to the phone's contact and calendar apps. If you're a fan of Sony's old Timescape, Rolodex-like display of social networking updates, you can install it as an app.

Sony's LiveWare Manager is another interesting utility: It lets you automatically launch an app when you connect an accessory, for instance launching the music player as soon as you plug in your headphones. This approach also comes into play with a new accessory called Xperia Smart Tags, little NFC-enabled stickers that can be configured to change your phone's settings or launch apps when you tap the phone to them. LiveWare Manager also provides a central place to manage the extensions for your Sony SmartWatch ($149, 3.5 stars), which puts email and social networking alerts on your wrist.

Of course, this being Android, it's compatible with all the 400,000-plus Android apps. Sony has made an unusually strong commitment to updating its phones, which makes us hope for an Android 4.0 update soon. But it's still disappointing that the phone comes with an older OS, especially now that the Samsung Galaxy S III and HTC One X are both shipping with Ice Cream Sandwich.

After Gay Marriage Comes Gay Divorce | Williams Institute

Soon after New York passed the Marriage Equality Act on June 24 last year, Katie Marks and Dese?Rae Stage?began planning their wedding day. A licensed masseuse and a photographer, both 28, the couple had been dating since 2008 and were already planning to get married ??in Boston over the Memorial Day weekend of 2012 ??but the euphoria of the moment moved everything forward. ?It was kind of one of those things, to be a part of history,? Des says. On July 30, the first Saturday that gay marriages could be performed in New York City, Katie in?a magenta dress and Des in skinny jeans and pink Chuck Taylors joined 23 other couples at the Pop Up Chapel, a one-day wedding event in Central Park, as part of New York City?s first wave of legally married gay couples. By January, though, things had started to come apart. Des and Katie have since separated and moved out of their Washington Heights apartment. They?re now one of the first married gay couples ? if not the very first ? in New York to divorce. ?I feel like I?m the president of the loneliest club in the world,? Des says. ?I was the first gay person in my group of friends to marry, and now I?m the only gay divorc?e I know.?

?Of course, the news made us sad,? says Bex Schwartz, one of the Pop Up Chapel?s organizers, ?but as ministers who perform weddings, marriage equality means marriage is marriage. Unfortunately, the other side is divorce is divorce.?

For all the best intentions, nearly half of U.S. marriages end in divorce. In a Williams Institute study by?M.V. Lee Badgett and Jody L. Herman?from November 2011, the authors chronicled data to provide a picture of the need for legal recognition of same-sex marriage and divorce. ?In the U.S., over 140,000 same-sex couples have formalized their relationship under state law and nearly 50,000 have married,? they write. ?The data show that same-sex couples marry at much higher rates than they enter civil unions or other legal statuses?. When a state allows marriage for same-sex couples, over 60 percent of those who marry come from other states.? Their research found that on average the divorce rate for same-sex couples is similar to, though slightly lower than, the rate for different-sex couples. About 1.1 percent of same-sex couples in legal unions end their relationship, they found, while about 2 percent of married different-sex couples divorce.

Few couples go into a marriage expecting to end up on the wrong side of these statistics. State by state, bit by bit, advocates of marriage equality have celebrated victories ? like New York becoming the sixth state to allow gay marriages, Obama?s long-awaited personal support, or the court reversal of California?s Prop. 8 ? and have mourned setbacks ? like North Carolina voters adopting a same-sex marriage ban. But the d-word almost never comes up. It?s certainly not a pleasant topic. And, indeed, there?s even a bit of fear: If we acknowledge that gay marriages can (and, based on the statistics for heterosexual couples, many of them will) fall apart, does it weaken the case for those marriages having existed in the first place? Of course not: Everyone should have a right to marry as well as to divorce. But we need to acknowledge that the rights of marriage are as much about moments of crisis as they are about the moments of happiness: when a spouse loses a job, the law continues health care benefits under COBRA; when a spouse is injured, the law grants hospital visitation rights; or when a spouse dies, the law provides Social Security benefits and inheritance. So, too, are divorce rights ? all the mechanisms jurisdictions have devised to divide a love broken, property, finances, and child custody ? most needed when a wedding day?s joy has long faded.

In the six states that allow same-sex marriage?Massachusetts, New York, Connecticut, Iowa, New Hampshire, and Vermont?plus the District of Columbia?heterosexual and gay marriage and heterosexual and gay divorce are still not quite the same things, largely because of the federal benefits gay couples don?t receive by marrying and federal protections they don?t have while divorcing. That gap is greater in states that only legally recognize civil unions, state-registered domestic partnerships, and limited rights statuses of same-sex couples, and even greater still in states that don?t recognize the relationships at all. Gay divorce is still largely ?uncharted territory,? says Elizabeth Schwartz, a lawyer practicing in Florida.

In New York, gay divorce is recognized because gay marriage is recognized, but that?s not the case everywhere. In Florida, for example, where gay marriage is not legal, same-sex couples who have married in another state are reliant on the discretion of judges. ?What I?ve been seeing,? says Schwartz, ?are people who?ve said, ?Wow, is it possible for me to divorce without having to move to that state [where they were married] and get residency?? And when there?s fighting over kids and assets?if you?re not in a state that recognizes same-sex marriage, there?s no alimony. You have to count on the generosity of your ex.?

Des is quoted, ?I know we?ve already started a life together, but I can?t wait to be able to call her my wife.?

They?d gone to middle school and high school together, but went their separate ways before reconnecting on MySpace in 2008.?On July 24, the first day that New York clerks issued marriage licenses to same-sex couples, Des and Katie picked theirs up at the City Clerk?s Office in downtown Manhattan. ?Couples were getting married and coming out of the courthouse, and there were musicians playing. I got chills every time a couple came out,? Des told me when I met with her at a bar in SoHo, her mood more somber than the festive events she remembered, or, for that matter, as I remember. At the time, I was covering New York?s first same-sex marriages for the Village Voice. I?d spoken to Des about how excited she was to be married. You could hear it in her voice. The New York wedding would be the ?no-stress? one, Des told me then, to be followed by the bigger formal ceremony in Boston. There would be cupcakes. The couple seemed giddy, thrilled, and very publicly in love.

That Saturday, July 30, their wedding day, Des says now, was the kind of whirlwind any bride speaks of. ?It went by so fast. We got our hair done, we got our makeup done. We changed, we went to Central Park. We forgot to eat, so we went to Whole Foods, and we?re like, We?re eating at Whole Foods and we?re about to get married. It was surreal. I was so excited.?

After the wedding, Des wrote on her blog, in a post titled ?We Did It!?

While the right to wed legally (in some states, that is) has inspired a wave of new couples to tie the knot, the opposite side of that is the fallout that occurs when things don?t work out. And, as several lawyers told me, gay couples often jump into marriage the same way many heterosexual couples do: Eager, euphoric?and without much time and attention given to the possibility of things going wrong.

?Most people aren?t checking with their lawyer before they get married,? says Schwartz. ?They?re doing what straight people do: ?I?m excited, let?s get married, and work out the problem later.?? Shannon Minter, Legal Director of the?National Center for Lesbian Rights, told us, ?Every time a state gets rid of a marriage bar, there?s a flood of couples. That makes sense, and maybe some people do it impulsively, caught up in the moment. But it?s a serious step, and it has significant legal consequences.? On the sort-of-bright side, Minter adds, ?I think we will continue to see people divorce. But nothing has humanized gay couples more than for straight people to realize gay couples need to divorce, too.?

?We have 34 [gay divorce] cases right now in the office, compared to 150 [heterosexual] divorce cases,? says Raoul Felder, a New York divorce lawyer who has handled numerous high-profile breakups including Rudy Giuliani?s split from his wife of 18 years, Donna Hanover, while he was mayor of New York. Felder?s growing case file did not yet include couples who?d wed in New York starting last June; instead they are couples who?d married in other states, like Massachusetts. With New York divorce law requiring marriages to be ?irretrievably broken??for at least six months before couples can file for a no-fault divorce (which is itself relatively new in New York state, adopted only in 2010), cases like Des? and Katie?s will be some of the earliest to come down the pike. Felder added that gay divorces are currently ?filtering down at a faster rate than heterosexual divorces.?

The patchy legal protections for gay couples who are married or have civil unions provide vengeful exes all sorts of ways to get back at their former spouses. ?I met with two different women breaking up with their partners with whom they?ve been for more than 20 years,? Schwartz told us. ?Both of these women in one way or another were like, ?I don?t want her to be out on the street, I want to be fair.? Then I have people who come to me and say, ?This person never works, do I have any obligation?? There?s what the law requires and what law and ethics require. Plenty of people take homophobic positions, using the law to their advantage.? She adds, ?The kid thing is the heartbreaker. A biological mom saying, thanks for everything, you?re out of luck,? to her former partner, who has no legal rights to the child. Or, with a 401(k), she explains, ?there?s a mechanism for dividing that asset upon a heterosexual divorce,? but it does not exist for gay couples even in states where their marriages are recognized. ?Overall,? she says, ?there?s a sense that we?ve been crafting our way into this marriage, we?ll have to craft our way out. We have the added obstacle of not having a legal system to arbitrate, so it?s up to us.?

The Internet can be a tough place to showcase a relationship, but it?s a tougher place for one to implode. Along with photos of the happy couple on Des?s blog and on the Pop Up Chapel site to serve as a reminder of what was and what now is not, there was an online chronicle, tumultuous, emotional, and vengeful at times (much has since been deleted) of the couple?s divorce-in-progress, on social media sites and Internet forums.

?January 28 is the day I can really pinpoint that something started,? Des says. Katie had become involved with another woman, whom she?d met via the social media site Instagram. Prior to that, as Des tells it, ?There was never an indication of anything wrong. I was so invested in being married.?

I was in touch with Katie as I gathered the facts for this piece. There are two sides to every story, particularly in a breakup, and I offered her the chance to share hers and to respond to Des?s statements about the dissolution of their marriage, as well as to talk about her feelings on gay divorce in general. Ultimately, she declined to comment, explaining, ?Although we are on good terms currently, it took us a long time to get here. Des is very open with what happened between us and her entire life really. I am the absolutely opposite.?

On February 3, Des found suspicious emails between Katie and another woman. ?Somehow, between the 22nd and the 3rd of February, I lost my wife,? she says. A month of attempting to work things out followed, with phone calls and visits with families, talks, and tears, but the end, for Des, was finding out that Katie had gone to visit the other woman, now her girlfriend, in Tampa in March. ?During that process everyone said, you?ll know your boundaries, and I just felt, if she?s in Tampa with the girlfriend, I?m done,? she said.

Her reaction was to post about what was happening on Twitter, Instagram, and Facebook. Sometimes Des?s posts also involved talk of new women she was seeing. ?All the stuff that came out publicly, on social media,? Des told me, ?I don?t regret it. I was feeling vindictive. I knew her family would sweep [the breakup] under the rug. Was it immature or unkind, yes, but I don?t regret it.?

Now, Des says, ?I?m trying to find the most loving way to get us through this practically ? divorce paperwork, credit card bills ? and personally ? with the hope of maybe someday being able to carry on a friendship ? but I do believe we never should have been anything more than friends.?

Some states and judges have upheld draconian policies against gay divorce; you hear about cases in which people are ?wedlocked,? says Schwartz, which seems particularly ironic as those states don?t support gay marriage in the first place. ?If you?re against same-sex marriage, you certainly should be for divorce,? Schwartz says. ?My sense with judges granting divorces [in non-recognition states] is that they?re finding that the law preventing relationship recognition is against public policy, and they don?t see a downside to letting people out. I imagine that providing this one small measure of dignity to this couple is more important or outweighs the risk to society to not do it.?

Not allowing same-sex couples to get divorced has led to another problem, too: Bigamy. ?People are jumping in without being informed, get out, and jumping into another relationship,? says Schwartz. Minter adds, ?It is a very serious problem, and we?re going to see more of those situations?where people find themselves in really awful legal situations, where the couple didn?t divorce because they couldn?t. If one of them moves to a state where the marriage is recognized, that person could come along, or creditors could come after them. We are already seeing cases where people don?t understand they cannot re-marry. We?re starting to see cases where there?s a second marriage.?

There?s also the emotional side of divorce, ratcheted up even further with gay couples, says Felder. ?The antagonism and anger in these divorces is enormous,? he says. ?These people have been so misused by the system and treated so shabbily. When they?re finally able to get married and it doesn?t work out, there?s a terrific letdown. Gay women who have children, one way or another?they had to go through a lot more. But that?s the price of progress, you?re dealing in a zone of very raw emotions now.?

As painful as all divorces can be, few carry the weight of history. ?When the Marriage Equality Act was passed, I felt I?d been granted an amazing privilege: a set of rights I would cherish forever because they would protect my family,? Des told me, ?So, to me, this divorce struck deeply on more than just a personal level. It was political, too. The feeling of that privilege having been squandered is soul-crushing.?

Her best memory of her and Katie together, she says, was of the banter, the back and forth, the easy teasing relationship the two had. ??I loved our road trips and our mutual love of bad pop music. We had fun cooking together.?For a while, we were able to carry on a surface relationship (including divorce jokes),? she says, ?but as of late, I?ve found that maintaining a dialogue with her hurts me.??The pain is a point they can agree on. ?I don?t think there is a difference between hetero and gay divorce,? Katie told me. ?They both suck.?
