Gunman kills one in shooting at Wyoming college: report

LOS ANGELES (Reuters) - Honda Motor Co introduced its redesigned Civic sedan only a year-and-a-half after a major model change of the best-selling compact car in the United States. Even Honda admits that the 2012 Civic, introduced in the spring of 2011, missed the mark. For a company that prides itself on rock-solid reliability, it was a shock last summer when influential Consumer Reports ranked the Civic dead last in a field of 12 compact sedans it tested. Sales of the new Civic, a 2013 model, will start this week and the refreshed car was shown off on Thursday at the LA Auto Show. ...

Elderly Pharmaceutical Insurance Coverage Funding Restored in ...

In January, May's copayments will return to $20 each, the same copay he was charged in 2011.

After cutting the EPIC budget by about $12 million to help erase a $10 billion state budget shortfall, the legislature earlier this year restored EPIC funding for Jan. 1 to March 31. What will happen when the 2013-14 fiscal year begins April 1 depends on Gov. Andrew Cuomo (D) and the state legislature.

Before the cuts, roughly 190,000 low- and middle-income New Yorkers 65 and older relied on the program to supplement their Medicare Part D and any prescription insurance coverage they had.

Cut was "devastating"

Under the scaled-back program for 2012, EPIC was free but was limited to low-income people and did not contribute toward copays until a Medicare enrollee and his or her insurer had spent $2,930 on prescriptions, the point where the Medicare Part D "doughnut hole" begins.

The changes were "absolutely devastating to many seniors, especially those with serious or chronic illnesses," said Cathy Roberts, who works on health care access issues at the Empire Justice Center in Albany.

For instance, Muriel Kenitz, of Galway, stopped taking one of her prescriptions, a hormone medication to help sharpen her memory, relieve severe headaches, prevent osteoporosis and lower cholesterol.

The news of the EPIC restoration is a "major relief," said Kenitz, who turns 74 this month. "But all that money I lost [paying for other medications] I won't recoup."

Kristin Legere, AARP New York communications director, said people reported being shocked when they went to a drugstore to pick up a prescription and found the price had skyrocketed, sometimes by hundreds or thousands of dollars.

Most EPIC enrollees paid about $875 in additional out-of-pocket costs for their medications in 2012, an AARP New York analysis found.

May, a retired rabbi in Rockaway, Queens, said he had heard about the cuts but didn't realize the full significance. After his shock at the pharmacy counter in January, May got angry. Then he got busy.

He participated in an AARP New York tele-town hall meeting in which the EPIC cuts were discussed. He also called his legislators to express dismay over the cuts, spoke at community organization meetings and talked to friends.

Next page: The cuts triggered a rigorous lobbying effort. ?

Smart Senior: Senior Health and Fitness: Winter Walking

?I love fall and winter!? I wouldn?t like living where the weather is the same all year around. ?The beauties of spring, summer, winter and fall are magical and need to be experienced to be believed.? The magic ends when accidents happen.? We can?t ignore the fact that incidents of slips, falls, and automobile accidents increase dramatically during the fall and winter months. ??It is hard to resist taking a walk on a beautiful fall or winter day, but soggy leaf piles and roads covered with snow and ice can be treacherous.

?Be careful whether you walk for exercise or just need to get safely from point A to point B.? You can?t stay indoors all winter long.? You can?t let winter hold you hostage.? It is important to be prepared and be extra mindful of your surroundings.? With a little extra effort you can keep on walking and enjoy the crisp sunny days.?

Be careful.? It is slippery out there.? Every block will present a new challenge.? Ice-free sidewalks are okay, but walking on packed snow requires more caution.? Take your time, walk slowly and take shorter steps on icy or snow covered sidewalks and streets.? Be extra wary of car traffic.? Inexperienced drivers may not be able to stop at crosswalks or may skid out of control when applying the breaks.

?It is dark later in the mornings and it gets dark earlier at night.? Do your walking during the nicest parts of the day (if you can).? I?ve had to move my 7-8 p.m. dog walk up to 2:30 in the afternoon and that is quite an adjustment for me.?? Keep warm.? Dress in layers, wear gloves, and a warm fuzzy head cover.?

Trade your sneakers in on good supportive walking boots or trail shoes.? They will provide better traction, and if you pick your route carefully you should be able to enjoy a nice winter outing.? Consider a walking stick with an ice-pick tip and remember that you can get slip-on traction devices that will fit right over your shoes.?? If you are walking for exercise you might want to reverse your normal route so that the wind will be at your back on the way home. ?Facing the wind when you are already exhausted can turn a pleasant outing into a nightmare. ??Don?t put your exercise routines on hold during fall and winter months.? If you don?t feel comfortable walking out of doors try mall walking, join a gym, or buy walking videos that you can do in? your own living room.? Enjoy the pleasures of walking every month of the year.

Groupon CEO Decision - Business Insider

Michael Seto for Business Insider

Yesterday, three news stories appeared that reported essentially the same thing:

Board members at Groupon were discussing firing the company's CEO, Andrew Mason.

These news stories did not cite each other. Rather, they cited "sources" close to the situation. (Kara Swisher at All Things D broke the story.* Then Bloomberg and the Wall Street Journal followed. Kara Swisher is a great reporter and may have flushed out the information, but sources confirmed it--not just to her but to the WSJ and Bloomberg*).

Often, when separate news stories contain essentially the same information and don't cite each other, it means that a person or company wants the information out there.

In the case of the Groupon, it was not immediately obvious who stood to gain from the Andrew Mason information.

It didn't help Andrew Mason, certainly.

And it didn't help the company, whose leadership was suddenly thrown into limbo.

And it didn't help the board as a whole, which looked like it was stabbing its CEO in the back.

It seemed unlikely that high-quality publications like All Things D, Bloomberg, and the Wall Street Journal would run with secondhand information. So it seemed the information had come directly from (or at the behest of) one or more of the board members who are discussing firing Mason.

Judging from the Wall Street Journal's story, which cited "fractures" and "clashes" between Andrew Mason and board members Eric Lefkofsky and Brad Keywell, it's not hard to guess who those board members might be.

In any event, leaking information like that was a cutthroat thing to do.

And it put Andrew Mason in an incredibly awkward position.

For one thing, it forced him to address in public the question of whether the board might fire him, which he did at our conference today in New York. Mason had a good answer for that question: With the stock getting clobbered, of course the board was discussing whether he is the right guy for the job. But boards generally have those discussions in private, not in newspapers.

Importantly, if everyone on the board wanted to fire Mason, there would have been no need to leak the story. The board could just have canned Mason at the upcoming meeting and announced the news when it was a fait accompli. So it seems likely that a board member or two want to oust Mason and other board members don't--and that the ones who do want to oust him blindsided him.

(That was the impression I got in our interview today, by the way--that Mason had been blindsided. He was articulate and composed, but he also seemed almost resigned to the fact that he was going to get canned).

It will be interesting to one day get the full story.

It will also be interesting to see how the situation plays out.

And inasmuch as someone on the Groupon board apparently wants us to have a public discussion about whether Andrew Mason should be canned, let's go ahead and have one.

The fire-Mason case is clear:

  • Groupon's stock has had an abysmal year since its IPO a year ago.
  • Groupon's international business is imploding.
  • The growth of Groupon's core daily deal business has slowed to a crawl, and the product still clearly needs tuning (there are too many anecdotal stories of merchants not liking the product)
  • There has been some senior management turnover
  • A big part of the problem at the company is external perception (which starts at the top)
  • Andrew Mason has only a few years of business experience and is now responsible for turning around and managing a massive global corporation, winning over Wall Street and the media, instilling passion and confidence in tens of thousands of rattled customers and employees

The give-Mason-more-time case, however, is also compelling:

  • Groupon has likely grown faster than any company in history--from zero to $2.5 billion in revenue, 12,000 employees, and profitability in less than four years
  • Groupon is still growing
  • Groupon is making money
  • Groupon has crushed almost all of its competitors
  • Groupon has successfully launched a new business--merchandise--that is already doing more than $1.5 billion of annualized revenue
  • Groupon's North American business is still doing well--it's the acquired companies in Europe that are the problem
  • Mason has a lot left to learn, but he is learning quickly
  • All companies go through rough periods.?

What decision will the board make? What's the right decision?

That's a tough one.

In my opinion, it depends a lot on Andrew Mason.

Andrew Mason has led Groupon this far (and very few observers appreciate how spectacularly hard that has been to do). If Andrew Mason wants to fight to keep his job, commits to learning more about how to run a multi-national corporation and communicate better with Wall Street and the media, and remains excited and passionate about his job, then he should be given more time. Not an indefinite amount of time, but more time.

If, on the other hand, Andrew Mason has learned that managing a huge global corporation, dealing with the media and investors, and continuing to build and manage a top-notch senior executive team is just not as much fun or as rewarding as leading Groupon in the early years, then he should step aside (or get canned).

This, by the way, is not a new situation for a founder-CEO to find himself in.

The skills and leadership ability required to grow a startup are different than those required to turn around and manage a vast global corporation. And many talented entrepreneurs and executives decide that they prefer one to the other.

I have huge respect for Andrew Mason for doing the interview today. Most CEOs would have cancelled the conference appearance. I also have huge respect for what Mason and his team have accomplished at Groupon over the past three years.

If Mason wants some more time to prove himself and fix Groupon, the board should give him more time.

If he doesn't, I hope he resigns quickly, helps hire a great new CEO, and then eventually gets more credit for building the company than he has to date.

The reason that leak was so ruthless, though, is that it will be hard to recover from.

Groupon's CEO has been placed in limbo.

At today's board meeting, the board will have to do and then say something. And even if the board decides to give Mason more time, everyone at the company (and in the world) will know that that's what they're doing. And they will also know that Mason's grace period will be short. That will hurt Mason's authority, both internally and externally, which will make it even more difficult for him to succeed.

(Yes, the board could put out a statement saying that it has "complete confidence" in Mason or something, but under the circumstance, this would be laughable.)

To resolve the situation in Mason's favor would require the resignation of the board members who want him gone. But even this wouldn't fix it. Everyone would know why these board members were quitting--because they had lost confidence in the CEO--and that wouldn't help Mason's authority, either.

Even if Andrew Mason wants to fight for his job, in other words, it will be a tough fight to win.

Whoever stabbed him in the back knew what they were doing.

SEE ALSO: Groupon Stock Soars After CEO Andrew Mason's Conference Appearance

* To be clear: I'm not suggesting that this story was actively "placed" with Kara Swisher. Swisher is an aggressive and experienced reporter, she is deeply sourced at Groupon, and this was a great scoop. Andrew Mason was originally scheduled to appear at our conference on Tuesday. On Monday evening, Groupon canceled his Tuesday appearance and did not immediately confirm a Wednesday appearance. Normally, late cancellations like this mean something. Swisher likely assumed that this one meant that Mason was in trouble and called Groupon sources to confirm that. The point I am making is that at least two of Swisher's Groupon sources elected to say that the Groupon board was "seriously discussing" firing Andrew Mason. The sources did not have to say that. And they then did not have to say the same thing to Bloomberg and the Wall Street Journal. The sources could have said nothing. Given the sophistication of some of the people involved, I believe the sources knew full well what would happen if they confirmed Swisher's perfectly reasonable questions. They don't call it "boardroom intrigue" for nothing...

Syrian hospital officials say twin car bombs near Damascus have killed at least 20 people

With 47 percent of the popular vote, Mitt Romney may become the president of nothing more than Ironystan. Yes, the final general-election tally is trickling in and, as fate would have it, Romney's total might look more like that mythical number after all. Well, according to David Wasserman of the Cook Political report, it's more like 47.49 and dropping, which, of course rounds down to 47 ? the same percentage of Americans?he said were moochers and takers in a video?that was one of the nails in the coffin of his presidential campaign.

How To Make It Last: Three Keys To The Long-Distance Relationship

This isn?t about love. But it is about a successful, long-term client relationship ? how it has evolved and matured ? and how, with constant refocus, it keeps moving forward.

Graphica has partnered with Crown Equipment Corporation for a long time. Creative Director Drew Cronenwett remembers when he arrived at Graphica as a rookie designer 26 years ago: a Crown collateral piece was his first project.

Since then, Crown has manufactured new equipment, developed new programs, and experienced all the ups and downs any large multinational company would. Of course, we?ve changed, too. But despite all the changing, we?ve consistently delivered spot-on strategy and design. Key #1: Build your relationship on a strong foundation.

Now, nearly three decades later, Drew heads up Crown Europe for Graphica. In fact, he recently returned from a three-week trip to Crown Europe headquarters in Munich, Germany. He ate wiener schnitzel and took some incredible photos. But, most of all, he drove reach trucks, toured warehouses and manufacturing facilities, and talked about upcoming products and strategy with his Crown counterparts ? I?m pretty sure he shared a few beers with the team, too. Key #2: Stay in touch. Stay informed. Nothing can replace face time, and even if you have to travel thousands of miles, let them know the relationship is worth it.

In part, what Drew discovered is that Crown?s needs have changed. As they look to the future, they intend to incorporate more technology and software into the design of their heavy equipment. In addition, they plan to approach their clients ? including those in Russia, the Middle East, and even Africa ? with a new way of marketing their products.

New technology? Strategic ways to reach your targets? Emerging markets? We?re listening. In fact, we?re already working on it (check out our recent Ektron certification). Turns out, Crown?s interests have changed much like Graphica?s capabilities. So Drew hit the ground running once he arrived back stateside, and big new projects are already in the works. Key #3: Listen. Respond. Be prepared to do what it takes to move the relationship forward.

Dear Abby has nothing on us. We value our client relationships, we invest in them and we know how to make great relationships, like that with legacy client, Crown, grow and get better with time. Most importantly, we know that healthy relationships are the only key to good business.

No consensus on whether ECB will cut rates next year: Reuters poll

LONDON (Reuters) - Whether the state of the euro zone economy will force the European Central Bank to cut its main interest rate to a new record low has economists more divided than ever, a Reuters poll showed on Wednesday

While only a handful of the 71 economists polled this week said the ECB will trim its main rate from 0.75 percent to 0.5 percent next Thursday, they were split down middle over the possibility of a rate cut early next year.

The findings were little changed from a poll two weeks ago.

There are two schools of thought. On one side are those who point to the raft of poor economic data for this quarter that signal a deepening recession, warranting another interest cut, no matter how small its impact might be.

And with the sovereign debt crisis still festering, there are few signs of an imminent turnaround for the euro zone economy. Most point to a worsening recession.

On the other side are those who say ECB President Mario Draghi has shown no inclination to ease monetary policy again, and is instead waiting to see how its bond-buying program - called Outright Monetary Transactions (OMT) - fares.

"The ECB has made clear that its policy is already very accommodative. Going forward, it puts most emphasis on improving the financial environment with the help of its OMT program," said Kristian Toedtmann, economist at DekaBank.

"Therefore, a further rate cut is less likely. A rate cut would only have major effects if the ECB also reduces the deposit rate, so that it becomes negative. At the moment, the ECB doesn't seem willing to do so."

Draghi declined to comment after the November policy meeting on whether markets were right to expect a rate cut next month, saying only that monetary policy was "very accommodative".

He also said the policymaking Governing Council had not discussed what it would do next year.

Thirty-four out of 71 economists forecast a rate cut by the end of the first quarter next year, turning to 36 by the end of the second quarter.

Those who said the ECB will ease policy again soon also cited easing inflation, which fell to 2.5 percent in October from 2.6 percent in September. Preliminary data for November due on Friday are expected to show another fall to 2.4 percent.

"We expect the ECB to cut interest rates further, as it is likely to become more obvious to the General Council inflation will undershoot the target of close, but below 2 percent in the medium term," said Juergen Michels, economist at Citi.

He expects the main refinancing rate will be trimmed to 0.5 percent in the first quarter of 2013, followed again by a cut to 0.25 percent in the second quarter, in combination with the deposit rate turning negative in mid-2013.

The ECB will also publish its latest staff forecasts for the euro zone economy at next Thursday's meeting.

A strong majority of economists - 34 out of 37 - said the ECB would chop its outlook for economic growth in 2013.

Google settles patent lawsuit from Immersion over Motorola use of haptic feedback

Motorola Droid RAZR family 2012

Immersion is known for guarding its haptic feedback patents with enthusiasm -- just ask Microsoft, among others. Motorola learned first-hand when Immersion sued over the use of basic haptic technology in May, but all that's water under the bridge now that Motorola's new parent Google is settling the matter out of court. While the exact sums aren't public, Google will pay Immersion to address any relevant past shipments, license the patents for future Motorola shipments and take care of "certain issues" with Google-badged hardware using the disputed vibration techniques. Immersion's end of the bargain is simply to end its legal action, including an ITC complaint, although the company makes clear that non-Motorola Android phones aren't covered by the deal. We're sure Google isn't happy to shoulder additional costs on top of its $12.5 billion Motorola acquisition, although it may see the settlement as a matter of establishing focus. After all, there's bigger fish to fry.

Google Voice Search For iPhone Commercial: How Accurate Is It, Anyway?

Back in August, when Google announced improvements to its voice search capabilities on Android and iOS, it released a slick little commercial showing all of the answers iPhone users could now expect its Google search app to return to them with a simple touch of a button and a few vibrations of the old vocal chords:

"Watch out, Siri," the commercial seemed to subtextually say. "Here comes a voice assistant for the iPhone that will actually understand you and deliver the answers you expect it to!" (Those two functions, of course, being the two main criticisms of Siri, which many users felt overpromised and underdelivered when it was introduced with the iPhone 4S in 2011).

In the past, we at HuffPostTech have tested several Siri commercials for ourselves, recreating each scene of the advertisements here at our offices in order to test their claims in real life and cutting together a quick video to show you the results. Can Siri really call you a rock god? (No). Inform Zooey Deschanel whether or not it is raining outside? (Yes). Tell John Malkovich a joke that will make him laugh from the very bottom of his soul? (Sort of).

Having thoroughly put Siri through her paces (with mostly positive results), then, we decided to give Google's refreshed and improved voice search application, which landed in the App Store this past October, a little trial. Below, you can check out the outcome.

A few notes on filming:
- We're using an iPhone 4S, about 10 months old.
- The phone is connected to our trusty AOL office Wi-Fi.
- We only ask each question once and use the video of the first take -- when it comes to voice search, you don't want to have to repeat yourself, so we don't.
- I tried to speak with the same neutral accent as the family in the video, preparing for a vacation to Cape Cod (way to relate to the blue-collar family, Google!).
- I drank a cup of hot tea before filming, so that my voice -- which someone who works for the New York Times once called "Pavarotti-esque" -- would come in clear on the iPhone's microphone.
- Wardrobe by Kmart.

And now, without further ado: Google's Voice Search for iOS Commercial gets put to the test. Press play to find out how Google performed...

As you can see on the video, we were able to replicate all but one of the voice searches shown in Google's original ad; after filming, we tried the mechanic query several more times but were unable to bring up local listings on any of our attempts. Overall, however, Google's voice search impressed me with its speed, both in finding an answer and transcribing the words I was speaking. It's almost startling how quickly your words appear on the screen after they leave your mouth, in fact.

Now if only there were some way to access that voice search straight from the home screen, without having to open up an app. I wonder if some other phone, with some other operating system, offers that function?

You can try out Google's voice search for iPhone yourself by downloading the Google app in the App Store right here.

BlackBerry maker RIM loses patent dispute with Nokia

HELSINKI (Reuters) - BlackBerry maker Research In Motion Ltd (RIM) has lost a dispute over the use of Nokia Oyj patents, in a case which could halt the sale of RIM products if it does not reach a new royalties deal with the Finnish company.

The Swedish arbitrator ruled RIM was not entitled to make or sell mobile devices which can hook up to WiFi networks - using technology known in the trade as WLAN or wireless local access network systems - without first agreeing royalties with Nokia.

"RIM is liable to pay royalties and damages to Nokia for its ... sales of any subscriber terminals (handsets or tablets) ... compatible with the WLAN standard," the arbitrator said in the ruling, issued on November 6 but not publicized until Wednesday.

"RIM has not contested that it manufactures and sells products using WLAN in accordance with Nokia's WLAN patents," it added.

The decision is a boost for Nokia which is trying to increase its royalty income as its phone business slides, and the group said it had filed cases in the United States, Britain and Canada to enforce the arbitrator's ruling.

"This could have a significant financial impact to RIM, as all BlackBerry devices support WLAN," IDC analyst Francisco Jeronimo said.

A RIM spokesman declined comment.

A source close to RIM said the arbitration ruling was unlikely to have any immediate ramifications, as Nokia still has to fight a number of legal battles for the arbitration panel's ruling to be recognized in different countries.

But analysts said RIM would likely seek a royalty agreement with Nokia to avert any risk of sale bans.

"The arbitration decision is not appealable and the U.S. Court can be expected to enforce the judgment by issuing an injunction against RIM, which would effectively put RIM out of business," said Alexander Poltorak, chief executive of patent consultancy General Patent Corp.

"RIM has only one choice now - to license Nokia's patents," Poltorak said. "It should be a quick process. No substantive issue will be re-litigated. The U.S. court merely needs to enforce the verdict of the Swedish arbitration tribunal."

CONTRACT ROW

RIM, a smartphone pioneer, hopes new devices using BlackBerry 10 software, due early 2013, will rescue it from a prolonged slump in the face of competition from the likes of Apple Inc and Samsung Electronics Co Ltd.

"If a sales ban was imposed it would be a massive blow for RIM as it manages its transition to the new BlackBerry 10 software platform," said analyst Pete Cunningham at Canalys.

RIM promises its new devices will be faster than previous smartphones and will have a large catalogue of applications, which are crucial to the success of any new line of smartphones.

Shares in RIM were up 1.7 percent at $10.90 by 1146 ET on Nasdaq, while its Toronto-listed shares were up 11 Canadian cents at C$10.81.

Nokia said it signed a cross-license agreement with RIM covering cellular patents in 2003, a deal that was amended in 2008. RIM sought arbitration in March 2011 with the Stockholm Chamber of Commerce, arguing that license should be extended to cover WLAN patents.

Nokia, along with Ericsson and Qualcomm Inc, is among the leading patent holders in the wireless industry. Patent royalties generate annual revenue of about 500 million euros ($646 million) for Nokia.

Based on a Nortel patent sale and Google Inc's acquisition of Motorola Mobility, some analysts say Nokia's patent portfolio alone merits its current share price of around 2.50 euros.

However, the patent market has cooled since those deals were made and some industry experts say the "fair value" of patents in large portfolios is between $100,000 and $200,000, pricing Nokia's portfolio at up to 0.50 euros per share.

Nokia shares, which are heavily influenced by expectations of new smartphone model sales, were down 1 percent at 2.54 euros. The Wall Street Journal said the new Lumia 920 smartphone was worth considering but was heavy and thick.

Feds: Teachers embroiled in test-taking fraud

MEMPHIS, Tenn. (AP) ? It was a brazen and surprisingly long-lived scheme, authorities said, to help aspiring public school teachers cheat on the tests they must pass to prove they are qualified to lead their classrooms.

For 15 years, teachers in three Southern states paid Clarence Mumford Sr. ? himself a longtime educator ? to send someone else to take the tests in their place, authorities said. Each time, Mumford received a fee of between $1,500 and $3,000 to send one of his test ringers with fake identification to the Praxis exam. In return, his customers got a passing grade and began their careers as cheaters, according to federal prosecutors in Memphis.

Authorities say the scheme affected hundreds ? if not thousands ? of public school students who ended up being taught by unqualified instructors.

Mumford faces more than 60 fraud and conspiracy charges that claim he created fake driver's licenses with the information of a teacher or an aspiring teacher and attached the photograph of a test-taker. Prospective teachers are accused of giving Mumford their Social Security numbers for him to make the fake identities.

The hired-test takers went to testing centers, showed the proctor the fake license, and passed the certification exam, prosecutors say. Then, the aspiring teacher used the test score to secure a job with a public school district, the indictment alleges. Fourteen people have been charged with mail and Social Security fraud, and four people have pleaded guilty to charges associated with the scheme.

Mumford "obtained tens of thousands of dollars" during the alleged conspiracy, which prosecutors say lasted from 1995 to 2010 in Arkansas, Mississippi and Tennessee.

Among those charged is former University of Tennessee and NFL wide receiver Cedrick Wilson, who is accused of employing a test-taker for a Praxis physical education exam. He was charged in late October with four counts of Social Security and mail fraud. He has pleaded not guilty and is out of jail on a $10,000 bond. He has been suspended by the Memphis City Schools system.

If convicted, Mumford could face between two and 20 years in prison on each count. The teachers face between two and 20 years in prison on each count if convicted.

Lawyers for Mumford and Wilson did not return calls for comment.

Prosecutors and standardized test experts say students were hurt the most by the scheme because they were being taught by unqualified teachers. It also sheds some light on the nature of cheating and the lengths people go to in order to get ahead.

"As technology keeps advancing, there are more and more ways to cheat on tests of this kind," said Neal Kingston, director of the Center for Educational Testing and Evaluation at the University of Kansas. "There's a never-ending war between those who try to maintain standards and those who are looking out for their own interests."

Cheating on standardized tests is not new, and it can be as simple as looking at the other person's test sheet. The Internet and cell phones have made it easier for students to cheat in a variety of ways. In the past few years, investigations into cheating on standardized tests for K-12 students have surfaced in Atlanta, New York and El Paso, Texas.

Still, most of the recent test-taking scandals involved students taking tests, not people taking teacher certification exams. Cheating scams involving teacher certification tests are more unusual, said Robert Schaeffer, public education director for the National Center for Fair & Open Testing.

Schaeffer notes that a large-scale scandal involving teacher certification tests was discovered in 2000, also in the South. In that case, 52 teachers were charged with paying up to $1,000 apiece to a former Educational Testing Services proctor to ensure a passing grade on teacher certification tests.

Teachers from Arkansas, Georgia, Louisiana, Tennessee and Mississippi took tests through Philander Smith College in Little Rock, Ark., in 1998. The college was not accused of wrongdoing.

Educational Testing Services also writes and administers the Praxis examinations involved in the Memphis case. ETS spokesman Tom Ewing said the company discovered the cheating in June 2009, conducted an investigation and canceled scores. The company began meeting with authorities to turn over the information in late 2009, Ewing said.

"These cases are rare, but we consider them to be very serious and something we have to guard against happening for all the honest test-takers, students and teachers," Ewing said.

Ewing said ETS observes test-takers and reviews test scores to try to root out cheaters. ETS also has received anonymous tips that have led them to cheaters, Ewing said.

Prosecutors in the Mumford case say he, the teachers and test-takers used the Internet and the U.S. Postal Service to register and pay for the tests, and to receive payment. The indictment does not say how much he allegedly paid the test-takers.

An experienced educator, Mumford was working for Memphis City Schools when the alleged scam took place. Authorities say Mumford defrauded the three states by making the fake driver's licenses.

"What happens at many testing centers is that a whole bunch of test-takers show up simultaneously, early on a Saturday morning, and the proctors give only a cursory look to the identification," Schaeffer said. "It's not like going through airport security where a guy holds up a magnifying glass and puts our license under ultraviolet light to make sure it has not been tampered with."

Mumford was fired after news of the investigation came out, and others, like Wilson, have been suspended. But at least three teachers implicated in the scandal remain employed with their school district.

Kingston, the university professor, said prospective teachers may not be confident in their knowledge base to pass the test. Or, the cheaters may believe they are smart enough to pass on their own but also know they are poor test takers.

Kingston said his research has shown that cheating on exams is getting more prevalent.

"The propensity to cheat on exams both through college and for licensure and certification exams seems to be increasing over time," said Kingston. "People often don't see it as something wrong."

The pressure of passing the test could make people do things they normally would not do. And it could take a while for authorities and test-taking services to catch up with the cheaters.

"When people come up with a new method for cheating, it takes some time for folks to figure it out, partly because this has been an understudied area in the field of assessment," Kingston said.

Nina Monfredo, a 23-year-old history teacher at Power Center Academy in Memphis, has taken Praxis exams for history, geography, middle school content, and secondary teaching and learning.

Monfredo, who passed all her tests and is not involved in the fraud case, said the exams she took were relatively easy for someone who has a high school education. She said some people use study aids to prepare, but she didn't. And she didn't feel much pressure because it was her understanding that she could take the test again if she did not pass.

"If you feel like you can't pass and you hire someone it means you really didn't know what you were doing," she said. "I think it would be easier to just learn what's on the test."

Connecticut upsets No. 19 Louisville 23-20 in 3OTS

LOUISVILLE, Ky. (AP) ? Chad Christen's 30-yard field goal in the third overtime gave Connecticut a 23-20 upset of No. 19 Louisville on Saturday.

Blidi Wreh-Wilson set up the Huskies' winning score by intercepting Teddy Bridgewater's pass intended for DeVante Parker in the end zone. The Huskies ran three plays for 12 yards before Christen's second OT kick gave Connecticut (5-6, 2-4 Big East Conference) its second straight win.

Louisville (9-2, 4-2) dropped its second straight but still has a chance for a BCS bowl bid by beating first-place Rutgers (9-2, 5-1) on Thursday.

The Cardinals trailed 10-0 after three quarters and briefly lost Bridgewater with a left wrist injury before the sophomore returned to lead Louisville's fourth-quarter rally capped by his 6-yard touchdown pass to DeVante Parker with 21 seconds remaining in regulation.

After trading field goals in the first overtime, Johnny McEntee put Connecticut ahead with a 3-yard touchdown pass to Shakim Phillips before Bridgewater's 25-yard TD pass to Parker.

McEntee, who relieved an injured Chandler Whitmer in the fourth quarter, was 2 of 7 passing for 20 yards. Lyle McCombs rushed for 133 yards on 29 carries and Nick Williams scored on a 3-yard run for the Huskies.

Bridgewater completed 30 of 53 passes for 331 and two touchdowns but was sacked four times. Damian Copeland caught five passes for 95 yards while Parker added 91 on eight receptions.

Both teams were coming off byes, but the Cardinals looked like the ones still on a break.

Louisville was outgained 160-88 in the first half while being shut out for the first time since Pittsburgh did it here a year ago. Bridgewater's timing and mechanics looked particularly off with passes either underthrown or overthrown.

His receivers didn't help him by dropping passes, either. One flub by a wide-open DeVante Parker on the second drive brought an angry coach Charlie Strong on the field to yell at his players.

That still couldn't snap Louisville out of its initial funk against Connecticut's ninth-ranked defense, which was going to give up many yards to begin with.

The Huskies certainly didn't in the first quarter, forcing the Cardinals to punt four times. Connecticut cornerback Dwayne Gratz served notice how hard it would be for Louisville receivers by breaking up Bridgewater's first two passes and laying out tight end Scott Radcliff with a punishing hit that left him on the ground for several moments.

He did not return.

Connecticut's 11th-ranked run defense lived up to billing by hemming in Wright, getting the bulk of Louisville's carries following Senorise Perry's season-ending ACL tear two weeks ago at Syracuse. He gained just 25 yards on six carries while freshman Corvin Lamb got nine on three attempts.

And while Connecticut's offense wasn't great, the Huskies took advantage of their few opportunities.

After two three-and-out drives Connecticut moved 51 yards in eight plays to set up Christen's 39-yard field goal. Two drives later it was 10-0 as the Huskies drove 66 yards in 10 plays ending in Williams' 3-yard touchdown run.

Things got worse for Louisville just before the half when Bridgewater was sacked by Sio Moore and came up shaking his left wrist. He returned to the sideline midway through the third quarter and re-entered the game with 4:55 remaining.

Louisville finally got on the scoreboard early in the fourth behind Bridgewater, who connected with Damian Copeland for completions of 59 and 13 yards to reach Connecticut's 24. The drive stalled at the 2 but Wallace hit a 19-yard field goal to bring the Cardinals within 10-3.

A fake punt on Louisville's next drive gained just five yards and gave Connecticut the ball at midfield, but the Huskies soon punted to set the stage for Bridgewater's heroics in the final three minutes.

He directed a 92-yard, 13-play drive kept alive by a 28-yard pass to Eli Rogers and a 9-yarder to Wright for first down at the Huskies' 26. A 14-yard pass to Wright and a face mask foul penalty on Connecticut set up first and goal at the 6, and Bridgewater found a wide-open Parker in the end zone.

McIlroy wins Dubai World Championship by 2 strokes

DUBAI, United Arab Emirates (AP) ? Rory McIlroy made five straight birdies down the stretch to overtake Justin Rose and win the Dubai World Championship on Sunday, ending a historic year in which the 23-year-old Northern Irishman won the PGA Championship and the European and PGA tour money titles.

The top-ranked McIlroy recovered from early putting woes to finish at 6-under 66 for a total 23-under 265 at the season-ending tournament. Rose, who was tied for seventh after three rounds, surged down the stretch into contention after shooting a course-record 62 that included an eagle and eight birdies.

"I just wanted to finish the season the way I thought I deserved to finish the season," McIlroy said after holing a birdie on 18 and raising his arms in the air in celebration. "You know, I played so well throughout the year and I didn't want to just let it tail off sort of timidly. I wanted to come here and finish in style."

Second-ranked Luke Donald (71) was tied for third with Charl Schwartzel (68) of South Africa. Louis Oosthuizen (69) was another shot back in fifth.

The day was supposed to be a duel between McIlroy and Donald, who were tied for the lead after the third round. The Englishman grabbed an early two-shot lead when McIlroy bogeyed the first and Donald birdied the second.

But then Donald three-putted the third to end a streak of 102 holes on the Earth Course without a bogey to give McIlroy a chance. He then had another bogey on No. 12 to fall three back and never challenged after that, missing the green on the 17th to end his chances.

In the meantime, Rose was climbing up the leaderboard.

The Englishman pulled within one of McIlroy with a birdie and then moved ahead with an eagle on No. 14 after his approach shot rolled to within 10 feet. He sank it for his first lead of the tournament and doubled his advantage when McIlroy three-putted on the 13th.

Rose had another birdie before his 60-foot eagle putt came within inches of the cup on No. 18, and he settled for birdie. Then, he had to wait.

"I thought it was going to be good, to be honest," Rose said. "I caught a glimpse of the board walking to the 18th tee. I saw Rory had gone birdie, birdie, and he's putting the squeeze on. But I knew that is what Rory does."

At No. 17, McIlroy hit what was probably the shot of his tournament, landing a 5-iron within a few feet of the pin.

"You could easily be a lot right into the bunker and leave yourself a tricky up-and-down," he said. "I committed to it and hit a great shot and followed it with a great putt for birdie to give myself that cushion going into the last."
